The disciplinary policy for resident doctors in the Syrian Board of Medical Specialties

Any resident doctor registered in the Syrian Board of Medical Specialties who is found to have violated the administrative and professional work regulations shall be punished including:

  • Failure to comply with the instructions and policies issued by the Scientific Council, the SBOMS Board Directors, or the heads of departments of the Syrian Board of Medical Specialties.
  • Causing any moral damage to the relations of the Syrian Board of Medical Specialties, or speaking on its behalf in front of legal or corporate bodies without an official mandate.

Types of disciplinary penalties:

  1. The registered alert penalty: It is to notify the resident doctor with an official letter sent to him mentioning the committed violation, and drawing his attention to avoid repeating it in the future.
  2. Warning penalty: It is to notify the resident doctor with an official letter warning of more severe penalties in case of the violation continued or repeated.
  3. Depriving of an exam course penalty: depriving the resident doctor of one exam course.
  4. Deduction penalty: The deduction of maximum amount of 10% of the monthly salary- from the date of the penalty- for a period of not less than one month and no more than 3 months.
  5. Temporary dismissal penalty: the temporary dismissal of the resident doctor from the residency program for a period of no more than three months.
  6. Final dismissal penalty: the final dismissal of the resident doctor and depriving him of the continuation in the residency program through a specialized committee, and removing his registration from the records of the Syrian Board of Medical Specialties.

Instructions on sanctions:

  1. The first and second sanctions are imposed by the Scientific Council.
  2. Sanctions (3-4-5-6) are imposed by the Board of SBOMS.
  3. If the same offence is repeated more than twice, more severe penalties must be imposed.
  4. Two penalties can be combined for one offence.

Applying the decision of immediate dismissal to the resident doctor:

  • The decision of dismissal is made by a specialized committee set up for this purpose by several members representing:

    1. Two members of the Board of Directors of the Syrian Board of Medical Specialties.
    2. One member of the relevant scientific council.
    3. It is possible to add a member of the facility where the resident doctor is training, especially the supervising specialist.

    This is done in the following cases:

    1. If he/she does not succeed after having the four chances of applying in the primary exam.
    2. The resident is absent for 15 unjustified consecutive days or 30 intermittent days a year.
    3. Withdrawal from the training program.
    4. Impersonation of a resident doctor.or falsification of documents.
    5. revealing the secrets of work which causes harm to it.
    6. Drug and alcohol abuse at work.
    7. Accepting gifts and bribes or using the assets of SBOMS for personal purposes.
    8. Issuance of judicial decisions related to honesty or honor or issues of medical ethics.
    9. Proving that the resident doctor made a medical error on his own without returning to the supervising doctor causing loss of the patient’s life or a sustained disability.
    10. Practicing the profession outside the place covered by the contract with SBOMS, whether within its official or informal duty without the authorization of SBOMS.
    11. Assaulting colleagues at work or because of work itself.
    12. Repeat the violation which requires the imposition of a penalty of dismissal.

Grievance:

The resident doctor has the right to appeal against the decision of the imposed   penalty within 10 days from the date of   the notification decided.

The fate of the trainee who is dismissed from the residency program:

When dismissing any trainee from any specialization, he / she can apply for re-registration in the same or other specialization after two full academic years, where the application is studied by the committee dedicated to the study  of the reasons for the dismissal and the possibility of returning of him/her.
